This Privacy Notice describes the information Wellness Coaches USA, LLC d/b/a Ramp Health ("Ramp Health", "we", "our", or "us") collects, how we use this information, with whom we share it, and the choices you have in connection with this. This Privacy Notice applies to Ramp Health-related websites and services accessible on or by a domain owned by Ramp Health (each, a "Site" and collectively the "Sites") and any other electronic or digital products made available by Ramp Health that link to this Notice (collectively, our "Services"). For residents of the United States, if you interact with the Services as a recipient of Ramp Health health care services, Ramp Health may collect and store your Protected Health Information (“PHI”) (as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)) as a Covered Entity under HIPAA in our capacity as health care provider. For information on how we collect, use, and share your PHI, please refer to Ramp Health's Notice of Privacy Practices. Alternatively, when we receive personal information about you from your health care provider (who is not an employee of Ramp Health) or create, receive, maintain, or transmit PHI on behalf of your health care provider, we are acting as a Business Associate (as defined by HIPAA) to your health care provider. Therefore, we must do so in compliance with HIPAA and our agreement with your health care provider. The entity responsible for the collection and use (processing) of your personal information is Ramp Health. Through your use of the Services, we will collect personal information, which is information that identifies you or relates to you as an identifiable individual. We collect personal information directly and automatically as outlined below.
When you engage with certain Services, we will collect your personal information. Except as otherwise indicated, the personal information we collect is such that we need to carry out the requested action. If you do not provide us with your personal information, we would not be able to do so. We collect personal information when you:
Contact us or complete a form on our Website: When you contact us or complete a form on our Services, we collect from you, your personal identifiers (organization name, title, address, phone number, and email address) and any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you may have. Post to our Services: When you submit content to the Services, we will collect anything you decide to share, including photos, documents, text submissions, likes, and dates. We will use this information to enable social community features, validate incentive program requirements and share with providers current and past health status. Create an Account on our Platform: When you create an account in our Services, we will collect from you, your personal identifiers (name, email address, telephone number, address, city, state, country, ZIP code, gender, birth date) and account login information (selected username, password and security question answers). We use this personal information to create your account, communicate with you about the Services, and facilitate your access to the Services. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is the performance of our contract with you. If you are creating an account through your employer's agreement with Ramp Health, we will collect your employment information (name of employer). We will share this information with your employer to ensure your employer is appropriately billed for the services provided. We will also retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is performance of our contract with you. If you consent, we will also collect additional personal identifiers (gender, birth date, ethnicity), behavioral activity (physical activity, eating habits), mental health indicators (e.g. stress, burnout, social determinates) and health information (health goals, diet preferences, sleep tracking data, heart rate, blood biometrics you wish for us to collect, blood pressure, and glucose level). We will use this information to provide the health-related services for which you have signed up through the Services. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is performance of our contract with you. If you consent (opt in) to receive promotional and account-related text messages to your cellular telephone number, we will use your cellular telephone number to send you automated promotional text messages. This information will be shared with our third party text message provider to facilitate the sending of the text messages. Message and data rates may apply. Reply “STOP” to any promotional text message to stop us from sending you future promotional text messages, or “HELP” for further assistance. Message frequency varies. Your agreement to receive promotional text messages is not a condition of any purchase from us.
Subscribe to marketing emails: : If you subscribe to our marketing emails, we will collect from you, your email address to fulfill your request to receive information we feel may be of interest to you. You can unsubscribe at any time by clicked on the “unsubscribe” link in each email. We will share this information with our third party email marketing provider to facilitate the sending of the emails. Please note that we will continue to send you notifications necessary to the Services, or requested products or services. Our communications contain tracking technologies, provided by and therefore shared with Pardot, to analyze whether a predefined action took place by a recipient, such as opening our communications, in order to better adapt and distribute our communications. When you opt-in to our marketing communications, you are opting into the use of these technologies. You can disable tracking by disabling the display of images by default in your email program. Participate in the Web Portal or Mobile Application: If you complete your registration on our Web Portal or Mobile Application, we will collect engagement data from you to help understand what content and services are most important to you. This data can include content consumption, answers to questions, communications with a healthcare provider, participation in events and contests, and interactions with other users. To the extent EU data protection law applies, the legal basis for this is our legitimate interest in providing you with helpful Services and improving the Services. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain.
Participate in a survey or questionnaire: If you decide to participate in one of our surveys or questionnaires, we will collect from you, your personal identifiers (name, email address) and your responses to the survey or questionnaire. We will use this information to analyze the participants interests, risks and behaviors to better service their healthcare needs. To the extent EU data protection law applies, the legal basis for this is your consent. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain.
Participate in Wellness Programming: If you participate in the wellness programming or the wellness portal, we will collect your health information (participation and engagement activity, such as self-reported activities, assessments, outcomes, lab results, tracker data, uploaded forms or affidavits) that will be used to target programming resources or to meet the requirements of incentive programming. Tracker data includes weight (weight, fat percentage, body mass index), diabetes (glucose, A1C), sleep (duration, quality), nutrition (calories), fitness (exercise type and duration), routine (steps), and biometrics (blood pressure, cholesterol, calcium). We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is performance of our contract with you and your consent. You can revoke your consent to further processing of your personal information by contacting member support or by working with your employer to be removed from the census.
Participate in a Vaccination Event: If you sign-up or attend a vaccination event, we will collect information about your personal identifiers (name, email address, telephone number, physical address), health information (general health status and health history), and payment information (insurance information) to properly administer and deliver the healthcare services offered at the event. We will also store a complete log of the services rendered at the event. Your data may be included in aggregate reporting or provided to a healthcare provider to continue with healthcare services in accordance with our Notice of Privacy Practices https://portal.ramphealth.com/en/hipaa.html. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. Participate in Health Coaching, Provider Services and Networks, Nutrition Counseling, Smoking Cessation Counseling, Safety and Injury Prevention Services, Clinical Services or Mental Health Services: If you interact with any of our Coaches or Healthcare Providers, we will collect your health information (e.g., medical conditions, lab results, symptoms, illnesses, diagnosis, treatment information, services and procedure rendered, insurance information, health status, health history, topics discussed, time spent, assessment results, biometrics, goals, diagnosis, prescription information, and provider notes) during those interactions to provide the particular services. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is your consent. You can revoke your consent to further processing of your personal information by contacting member support or by working with your employer to be removed from the census.
Participate in a Biometric Screening Event: If you register or attend a biometric screening event, we will collect your personal identifiers (name, email address, physical address, telephone number), payment information (payor or insurance information), employment information (employer name), and health information (e.g., biometric data (i.e. height, weight, BMI, blood pressure), lab results (i.e. glucose, cholesterol)), attendance information and demographicinformation. This data will be used to provide the participant with information about their current health status, fulfill incentive requirements and be reporting in aggregate to the sponsor of the event. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is your consent. You can revoke your consent to further processing of your personal information by contacting member support or by working with your employer to be removed from the census.
Participate in Vaccine Verification and Testing Program: If you submit your vaccine information for verification or participate in a testing program, we will collect your personal identifiers (e.g., name, birth date, phone, address, government-issued identification card), employment information (employee/member ID), and health information (vaccines administered and results from tests administered). This information will be used to provide the vaccine verification services and/or vaccine testing services, as applicable. Such information will be reported to the program sponsor or to regulatory parties as required by law. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. To the extent EU data protection law applies, the legal basis for this is your consent. You can revoke your consent to further processing of your personal information by contacting member support or by working with your employer to be removed from the census.
Communicate with us by telephone: When you communicate with us by telephone on a recorded line, with your consent, we will collect your identifiers (name) and auditory information (recording of your voice). To the extent EU data protection law applies, the legal basis for this collection is your consent. You can withdraw this consent at any time with effect going forward by letting us know on the call that you no longer wish to be recorded or, after the call, by emailing support@wcusa.com. We do not share this information with any third parties other than our recording provider. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain.
Apply for employment with us: When you apply for employment with Ramp Health, we will collect your personal identifiers (name, email address, physical address, telephone number) and your professional or employment information (resume, cover letter, employment history, educational history). We use this personal information to assess and manage your application with Ramp Health, to communicate with you, and as necessary to comply with the law. For more information, please see our Applicant Notice https://portal.ramphealth.com/en/applicant.html. To the extent EU data protection law applies, the legal basis for this is performance of a contract with you. We will retain this information for as long as necessary for the business purpose or to fulfill our legal obligations, unless you request to delete it, in which case we will only retain the information we have a legal obligation to retain. If you are hired, this information will be retained for the duration of your employment and seven (7) years after you are no longer employed with WCUSARamp Health, unless there is a legal obligation to retain it for a longer period.
Ramp Health Partner Information. We collect information about individuals within our Ramp Health Partners organization ("Partner Information"). Partner Information includes information related to the Partner's account identifiers (name, work email address, work phone number), and employment information (job title). We use Partner Information to support the Partner account, maintain our business relationship with the Partner, respond to Partner inquiries, or perform accounting functions. Ramp Health Partners may update personal information and password by logging into the Ramp Health Platform and updating their account. Ramp Health Partners may contact Ramp Health support in order to delete their Personal Data. In some cases, we may not be able to delete Partner Information, and in such cases we will tell you why. To the extent EU data protection law applies, the legal basis for this is our legitimate interest in the efficient operation of our business and the Services.
Information about our Partners' Contacts. We collect information about any contacts, such as practice groups, employees, insured parties, and others, that may be uploaded into the Ramp Health Platform ("Information about our Partners' Contacts"). Information about our Partners' Contacts include your personal identifiers (name, e-mail address, phone number), and employment information (job title). We use Information about our Partners' Contacts for the purposes of providing Services to such contacts. Ramp Health Partners may update or delete Information about our Partners' Contacts in the Ramp Health Platform. Ramp Health Partners may also contact Ramp Health support in order to update and delete such information. In some cases, we may not be able to delete such information, and in such cases we will tell you why. To the extent EU data protection law applies, the legal basis for this is performance of a contract with you.
Ramp Health may also use the personal information collected for the above purposes to comply with the law and for other limited circumstances as described in HOW WE SHARE YOUR PERSONAL INFORMATION.
Employers Insurance carriers, and group sponsors: When you are signed up or create an account through your employer or a group sponsor, we will collect from your employer or group sponsor your personal identifiers (name, email address, birth date, gender, address, city, state, zip, phone), payment information (insurance plan), and employment information (job title, department). We will use this information to invite you to participate in certain programs or determine your eligibility for particular benefits.
Health Care Providers: When you sign up to utilize our services, we will request your health information (health risks, fitness trackers, labs, biometrics, telehealth visit summaries, claims) from your existing health care providers. We will use this information to provide our Services, target programming and services to participants, meet requirements of incentive programs or inclusion in aggregate population health reports.
Biometric Testing Laboratories: When you utilize our Biometric Testing services, we will utilize a third party testing laboratory to test the sample. We will collect your health information (biometric test results) from the third party laboratory to provide our services to you.
In addition to the personal information you provide, we also collect information automatically via cookies as you use the Services. This information includes the following internet and other electronic network activity information:
Usage information: We use essential, performance, and analytics cookies to collect information about your interaction with our Services, such as what you access, what you click on, the frequency of access, and how much time you spend on the Services. We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; and (v) diagnosis and repair Services errors, and, in cases of abuse, track and mitigate the abuse. Device information: We use essential, performance, and analytics cookies to collect certain information about the device you use to access the Services, such as hardware model, operating system, and device preferences. We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; and (v) diagnosis and repair Services errors, and, in cases of abuse, track and mitigate the abuse. Location information: We use essential, performance, and analytics cookies to collect information about your location, which may be determined through your IP address. We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; and (v) diagnosis and repair Services errors, and, in cases of abuse, track and mitigate the abuse. Some features within our mobile application may only function upon confirmation of your location, and therefore such features will not be available if you choose not to provide your location data to us.

Google Analytics: We use Google Analytics to conduct analytics. In doing so, Google Analytics may set cookies on your browser, or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. Pardot: We use this tracking technology to conduct business to business marketing lead generation from social media platforms. In doing so, Pardot, part of Salesforce, may collect personal information to conduct such analysis. Pardot will use and share the information it collects in accordance with its Privacy Policy. For EU residents, the legal basis for the processing of your personal data is consent. Ramp Health may share the personal information identified in this Privacy Notice in the following instances:
With service providers: We share your personal information with our service providers that assist us in providing the Services, such as our payment processors, IT support, marketing provider, communications provider, healthcare service provider, insurance service provider, cloud and hosting provider, biometric testing laboratory provider, and email provider. To the extent EU data protection law applies, the legal basis for this is our legitimate interest in providing the Services more efficiently.
Within Ramp Health: Where necessary, we share your personal information within Ramp Health for legitimate business purposes in order to efficiently carry out our business and to the extent permitted by law. To the extent EU data protection law applies, the legal basis for this is our legitimate interest in carrying out our business operations efficiently.
In the event of a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our organization, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, we would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share your personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings. To the extent EU data protection law applies, the legal basis for this is our legitimate interest in carrying out our business operations.
For legal purposes: We will share your personal information where we are legally required to do so, such as in response to tax obligations, court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of use or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law. With our Client: We will share your personal information with your employer or insurance company, such as Ramp Health Partners when you utilize Provider Services. We share this information to provide the Provider Services through our client to you. To the extent EU data protection law applies, the legal basis for this is performance of a contract with you. We will make your personal information available to our client (e.g., your employer or insurance company, such as Ramp Health Partners) in accordance with the services we perform for our client. When requested, we will also share or facilitate the sharing of your personal information with third parties pursuant to instructions from our client, and as required by law, a Business Associate Agreement or Subcontractor Business Assocate Agreement. To the extent the GDPR applies, the legal basis for this is compliance with legal obligations. We will also share your personal information with your employer or your organization if you utilize an Enterprise Account. If you use an Enterprise account we will share your personal information to improve our client's health management, and for health research. The legal basis for this processing is your consent.
With your consent: Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time.
Ramp Health may also share anonymized and aggregated data ("De-Identified Information") in public reports about exercise and activity, or to Ramp Health Partners under agreement with us. Ramp Health may also disclose De-Identified Information for general research purposes and in research collaborations with third parties, such as universities, hospitals or other laboratories to determine the prevalence of particular conditions among users or to determine whether a user might be suitable for research or clinical trials. Ramp Health may also use De-Identified Information for commercial collaborations with private companies for purposes such as product design or enhancement of programs we provide.

For a Sale.
The California Consumer Privacy Act (CCPA) entitles California residents to certain rights. To the extent that the CCPA applies to our processing of your personal information, you would be entitled to the following rights:
Right to Access. You have the right to request what personal information we have collected, used, disclosed, and sold about you within the preceding twelve (12) months. You may only submit a request for access twice within a twelve-month period.
Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions.
Right to Opt Out. You have the right to opt out of the sale of your personal information to third parties. Ramp Health does not have actual knowledge that it sells personal information of minors under the age of sixteen (16) years.
Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, or opt out under the CCPA.

For requests submitted via email and telephone, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information. The interactive webform contains the information that we need to verify your identity and review your request.
Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.
Individuals in the European Union are entitled to certain rights under the General Data Protection Regulation (GDPR). If our processing of your personal information is subject to the GDPR, you may be entitled to the following rights:

If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. Correct or view your personal information: You may access your Ramp Health account profile to correct or view certain personal information of yours in our possession and which is associated with your profile.
Location settings: You can prevent your mobile device from sharing your location data by adjusting the permissions on your mobile device or within the Services.
Marketing emails: You may opt-out of receiving marketing emails from us by clicking the "unsubscribe" link provided with each email. Please note that we will continue to send you emails necessary to the Services or any assistance you request.
Marketing text messages: You may opt-out of receiving marketing text messages from us by responding "STOP" to any of our text messages.
Push notifications: If you have enabled push notifications, you maydisable these at any time by updating your device settings.

The personal data processed by Ramp Health will be retained for the period deemed strictly necessary to fulfil the purposes for which it was provided, including to allow you to utilize the Platform. However, Ramp Health may continue to store personal data for a longer period, as may be necessary to protect Ramp Health's interests related to potential liability related to our Services. Ramp Health will keep personal data for the purposes of marketing and profiling for ten (10) years from the provision of your personal data for marketing and profiling purposes unless you withdraw your consent.
